This Rental Agreement ("Agreement") is entered into between Foam Factory Rentals ("Company") and the customer named on the rental confirmation ("Renter"). It covers the Super E 4.0 foam machine and all accompanying equipment provided by the Company, including mixing barrels, stand or canopy, hoses, extension cords, and foam solution ("Equipment").
Self-serve rentals are provided for a 24-hour period beginning at the confirmed pickup time, unless otherwise agreed in writing. Full-service bookings are provided for the duration specified in the applicable package. Late returns of self-serve equipment may be charged an additional daily rental fee.
Self-serve: A refundable security deposit of $75 is collected prior to pickup and refunded once all Equipment is returned complete and damage-free. The Company reserves the right to deduct repair, replacement, or cleaning costs from the deposit for any Equipment returned damaged, missing, or excessively soiled.
Full-service & corporate: A $50 booking deposit is required to reserve your date and is applied toward the total package price. This booking deposit is non-refundable but transferable to a new date. The remaining balance is due in full before setup begins. We accept cash, card, and Venmo.
The Renter agrees to: operate the Equipment only as instructed at pickup and in any provided setup materials; keep the machine elevated at least 5 ft off the ground at all times during operation; use only foam solution provided or approved by the Company; supervise the Equipment and any minors present for the entire duration of use; and return all Equipment clean, dry, and complete within the agreed rental period.
The Renter/host must provide a power outlet and water spigot both within 100 ft of the setup area, on a grass or paved surface only (no gravel). The space must be cleared of sharp objects, glass, rocks, and debris before setup begins.
Adult supervision is required at all times during foam play. Foam parties are recommended for ages 3 and up, with parent discretion for younger children. No glasses, jewelry, or sharp objects should be worn in the foam. Participants should wear swimsuits or clothes they don't mind getting wet; foam is non-toxic but can be slippery, so bare feet or water shoes are recommended.
Foam play involves inherent risks, including but not limited to slipping on wet or foam-covered surfaces, minor skin or eye irritation, and equipment misuse. The Renter acknowledges these risks and agrees to supervise all participants, including children, and to ensure foam play occurs on the safe surface described in Section 5.
To the fullest extent permitted by law, the Renter/host assumes responsibility for supervising guests and any injuries occurring during the rental or party, and releases, waives, and holds harmless Foam Factory Rentals, its owners, employees, and agents from any and all claims, damages, injuries, or losses arising from the use of the Equipment, except to the extent caused by the Company's gross negligence or willful misconduct. The Company is not liable for damage to landscaping, clothing, or personal property. A signed copy of this Agreement is required before setup begins.
The Renter is responsible for the full repair or replacement cost of any Equipment that is damaged, lost, or not returned, beyond what the deposit covers. Normal wear and tear is not chargeable.
Foam events may be rescheduled free of charge for rain, high wind, or extreme cold, provided the Company is notified at least 24 hours before the scheduled start time. Booking deposits are non-refundable but transferable to a new date. No refunds are issued for cancellations made within 48 hours of the scheduled pickup or event time. Party/rental time begins at the scheduled start time regardless of guest arrival time.
This Agreement is governed by the laws of the State of Utah. Any disputes arising from this Agreement shall be resolved in the applicable courts of Utah.
By signing below (or by accepting these terms electronically at booking), the Renter acknowledges having read, understood, and agreed to this Agreement in full.
